Terms and Conditions of Service

These Terms and Conditions ("Terms") govern your use of the mySpleet application & website (the "App" or "Service"), operated by B&K Swiss Digital Assets GmbH, a company registered in Switzerland.

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the terms, you may not access the Service.

1. The Nature of Our Service

1.1. Purpose: The mySpleet App is a digital tool designed solely to facilitate and document co-parenting communication, scheduling, expense tracking, and shared information management between two separated or divorced parents.

1.2. Not Legal, Financial, or Medical Advice: mySpleet is a software tool, not a professional advisory service. The App and any content, resources, or guidance provided within it are for informational and organizational purposes only. They are not a substitute for professional legal, financial, or medical advice. You acknowledge and agree that we are not providing any such professional advice, and you must consult qualified professionals for advice tailored to your specific situation.

1.3. No Guarantee of Conflict Resolution: While our tools are designed to reduce conflict, we do not guarantee that use of the App will result in conflict resolution, compliance by the other parent, or specific outcomes in any legal proceeding.

2. User Accounts and Responsibilities

2.1. Eligibility: You must be at least 18 years of age and a legal parent or guardian to enter into this agreement and use the Service.

2.2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify mySpleet immediately of any unauthorized use of your account.

2.3. Truthfulness of Information: You represent and warrant that all information you provide to the App, including financial expenses, scheduled appointments, and contact details, is accurate, complete, and truthful.

2.4. Prohibited Uses: You agree not to use the Service:

To harass, abuse, or threaten the other co-parent or children.

To upload or transmit any content that is illegal, defamatory, or violates any third-party rights.

To attempt to modify, tamper with, or gain unauthorized access to the App's logs or data.

3. Data Integrity and Records

3.1. Record Integrity: All communication logs, schedule entries, and financial entries within the App are automatically time-stamped, dated, and stored to maintain their integrity and verifiability.

3.2. Non-Editability: You acknowledge that, due to the App's function as a record-keeping tool for potential legal use, you cannot edit or delete communication messages or financial entries once submitted and time-stamped. This feature is fundamental to the App's value in conflict resolution.

3.3. Data Ownership: You retain ownership of the content and data you create within the App. By using the App, you grant mySpleet a worldwide, royalty-free license to use, host, store, and process your data solely for the purpose of operating and improving the Service.

4. Financial Module Specific Terms

4.1. Expense Processing: The Financials module is a tracking and calculation tool. It relies entirely on the accuracy of the receipts and data entered by the users.

4.2. Reimbursement and Settlement: The App calculates the amounts due based on the split percentage entered in the account setup. mySpleet does not handle or guarantee the physical transfer of funds. Any payment functionality provided (e.g., links to third-party payment providers) is solely to facilitate the payment between co-parents, and mySpleet is not liable for any issues related to fund transfer, late payment, or non-payment.

5. Subscription, Payments, and Termination

5.1. Subscription: Access to the full Service requires a paid subscription. You agree to pay the fees applicable to your subscription plan.

5.2. Termination by User: You may terminate your subscription at any time. Upon termination, your account will be deactivated and switched to a limited viewing-only mode. Data retention policies are governed by our Privacy Policy.

5.3. Termination by mySpleet: We may terminate or suspend your access immediately, without prior notice or liability, if you breach the Prohibited Uses (Section 2.4) or fail to pay subscription fees.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall mySpleet or its suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; or (iii) unauthorized access, use, or alteration of your transmissions or content.

7. Governing Law and Dispute Resolution

7.1. Governing Law: These Terms shall be governed and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.

7.2. Dispute Resolution: Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Switzerland and in the corresponding city of the dispute.
